To qualify for a spousal visa, the marriage either hast to take place in Canada, or if performed outside of Canada it must be legally recognized both in the country where it took place and Canada. For example, if one partner is legally married to two or more people at once before entering Canada he or she would not be eligible for a Canadian spousal visa.Â
To be eligible to sponsor a spouse to come to Canada, you must be at least 18 years old and either a Canadian citizen or a permanent resident of Canada. If you are a temporary resident of Canada, such as a student or worker, you may not be eligible to sponsor a spouse unless you meet certain conditions. If you and your partner are not legally married, but you've have been living together in a conjugal relationship for at least 12 consecutive months, then under Canadian law it is considered as common-law partnership. Short absences due to business or family reasons won't affect the period of cohabitation; however additional evidence may be required by immigration authorities to prove that you share more than just a residence - such as proving you own a shared bank account, social media accounts and witnesses of your relationship.Â
The conjugal partner category is intended for couples that - due to local law or external factors beyond control (such as a lack of immigration status) - are unable to qualify under common-law and spousal relationships. A person who is living outside Canada, in a conjugal relationship with the sponsor for at least one year. You can sponsor a conjugal partner if there is a significant degree of attachment between the two of you, implying not just a physical relationship but a mutually interdependent relationship, and you’ve been in a genuine (real) relationship for at least 12 months where marriage or cohabitation (living together) hasn’t been possible for any reason.
Your child or the child of your spouse or common-law partner can be considered a dependent child if that child meets the requirements below on the day your complete application is received. This means if they’re under 22 years old, and they don’t have a spouse or common-law partner. Children 22 years old or older qualify as dependents if they have depended on their parents for financial support since before the age of 22, and they are unable to financially support themselves because of a mental or physical condition.
